| Falls Creek Alpine Resort Management Board (Resort Management) manages the site www.fallscreek.com.au. Below is the privacy policy for Resort Management as well as specific information which also applies to this website. 1. Resort Management is committed to protecting the privacy of personal information which we handle. Personal information is information which directly or indirectly identifies a person. 2. We collect and handle a range of personal information for the purposes of providing services or to carry out our statutory functions. We also collect some personal information for planning, funding, monitoring and evaluating our services and functions, but where practicable we remove identifying details from information used for these purposes. 3. In accordance with our responsibilities, the services and functions which we provide relate primarily to the areas of management, planning for the development, promotion and use of the Falls Creek Alpine Resort in accordance with the objects of the Alpine Resorts (Management) Act 1997. 4. We recognise that the nature of these services means that there is a possibility that some of the information we handle could be sensitive. 5. We recognise that privacy principles protect personal information both as a matter of individual right, and to support the public interest in ensuring Government can collect information necessary for its services. 6. We recognise the essential right of individuals to have their information handled in ways which they would reasonably expect - protected on the one hand and made accessible to them on the other. 7. These privacy values are reflected in and supported by our corporate behaviour. 8. We are bound by Victorian State privacy laws, the Information Privacy Act 2000, as well as other laws which impose specific obligations in regard to handling information. 9. We have adopted the respective Privacy Principles contained in the Victorian State’s privacy laws as minimum standards in relation to handling personal information. In broad terms this means that we: • Collect only information which we need for a specified primary purpose; • Ensure that the person knows why we collect it and how we will handle it; • Use and disclose it only for the primary or a directly related purpose, or for another purpose with the person's consent (unless otherwise authorised by law); • Store it securely, protecting it from unauthorised access; • Retain it for the period authorised by the Public Records Act 1973; and • Provide the person with access to their own information and the right to seek its correction. | |
Resort Entry Permit - Important Conditions of Purchase | |
| Resort Entry Permit is purchased from the Falls Creek Alpine Resort Management Board for use in the Falls Creek Alpine Resort Crown Land Reserve subject to the following conditions:- 1. The supplier, its employees and agents shall have no liability whatsoever in negligence, breach of contract or statute or statutory duty (including guarantees set out in Subdivision B of Division 1 of Part 3-2 of the Australian Consumer Law) to the entrant/user for death or personal injury arising in any way whatsoever from the supply of recreational services, including but not limited to, skiing, snowboarding, snowtubing, tobogganing, skiing or snowboarding lessons, the use of ski lifts, all ski area services and facilities including snow clearing, operations of the ski patrol, the condition, layout, construction, design or use of pedestrian areas, roads, car parks, buildings, ski runs or slopes or the presence of people or objects thereon or any associated sporting activities or similar leisure time pursuits associated in any whatsoever with being in snow affected terrain. 2. The entrant/user acknowledges that these activities are dangerous with many inherent risks as a result of which personal injury (and sometimes death) are common and ordinary consequences and assumes and accepts all risk of personal injury or death in any way whatsoever arising from such activities. 3. WARNING: If you participate in these activities your rights to sue the supplier under the Fair Trading Act 1999 if you are killed or injured because the activities were not supplied with due care and skill or were not reasonably fit for their purpose, are excluded, restricted or modified in the way set out in or on this notice. NOTE: The change to your rights, as set out in or on this notice, does not apply if your death or injury is due to gross negligence on the supplier’s part. “Gross negligence” is defined in the Fair Trading (Recreational Services) Regulations 2004. 4. The Permit must be fixed to the lower driver’s side of the front windscreen of the entrant’s vehicle. It remains the property of the supplier, is not transferable and cannot be resold. It is valid only for the date/s shown. No replacement or refund will be made for its loss or in the event of poor snow conditions or if any lift service or other facility is not operating or open. It is void if the seal is broken. The entrant/user shall comply with the Alpine Responsibility Code and signs or other directions of the supplier and the Permit may be suspended or cancelled and access to lifts, services and other facilities including access to the Falls Creek Alpine Resort Crown Land Reserve denied at the absolute discretion of the supplier for non-compliance or for reckless or careless conduct. ENTRY PERMIT CONDITIONS NOTE: The Permit must be affixed to the lower driver’s side of the front windscreen of the vehicle and with the expiry date clearly visible – (Regulation 11.(3) Alpine Resorts (Management) Regulations 2009). 1. Falls Creek Alpine Resort Management (including its agents and servants) will not be liable for any loss or damage caused to any vehicle or to anything in the vehicle except where it was caused by its (or its servants or agents) negligence. 2. All Signs must be observed at all times (including hours of darkness). 3. No vehicle should be left in any position to cause an obstruction. 4. The Permit holder must promptly obey and observe all directions of an authorised officer of Falls Creek Alpine Resort Management. 5. The Permit holder must comply with the Alpine Resorts (Management) Act 1997 and with its regulations. | |
Resort Entry Season Permit - Important Conditions of Purchase | |
| 1. The FALLS CREEK SEASON PERMIT is available to privately registered motor vehicles only (less than 13 seating capacity), excluding commercial motor vehicles. Commercial motor vehicles includes any motor vehicle which is used or intended to be used for carrying passengers for hire or reward. An “Early Bird” discount is available where the purchaser has submitted a correctly completed application form and payment prior to 1 May 2013. 2. All Resorts Season Permit price includes the cost of a 2013 Falls Creek Resort Entry Season Permit. The All Resorts Season Permit shall only be accepted as valid when displayed with the valid resort specific season pass, both of which must bear the same vehicle registration number. This permit enables resort entry to Mt Hotham, Mt Buller, Mt Stirling, Mt Baw Baw and Lake Mountain, subject to each resort’s terms and conditions of entry, during season of issue. 3. Falls Creek Season Permits relate to a specific vehicle. The registration number on the permit must not be altered. The permit is not transferable and if a breach of this condition is observed the permit will be withdrawn. The permit must be permanently affixed to the nominated vehicle immediately after issue. 4. Vehicles with valid Falls Creek Season Permits entering Falls Creek Alpine Resort may use the entrance station express lane but must stop if directed. 5. Where a vehicle with a Falls Creek Season Permit is sold, damaged or the windscreen broken, the permit must be removed and the parts (especially the permit number) returned to Falls Creek Resort Management for issue of a replacement. Permits are not subject to a refund in such an event. A replacement permit will only be issued to a vehicle registered in the same name as the original permit and proof of ownership via registration papers must be produced. A replacement fee of $25.00 will apply. 6. Furthermore, you acknowledge that Falls Creek Resort Management (including its servants and agents) will not be liable for any loss or damage caused to any vehicle, or anything in the vehicle except where it was caused by its (or its servants and agents) negligence. | |
Accommodation Transfer Service Terms & Conditions of Use | |
| 1. It is the passenger's (You/Your) responsibility to be at the pick up/departure point 15 minutes prior to the given time of your journey 2. You are allowed a maximum of two (2) pieces of luggage, skis or snowboard & accompanying boots and one (1) piece of hand luggage. 3. Falls Creek Accommodation Transfer Service (We/Us) reserve the right to charge an additional fee or decline carriage of oversized items. Subject to Clause 4 hereto, each item of extra luggage beyond the standard allowance will incur an excess baggage charge of $3.00 per item, per trip. 4. Extra luggage will be assessed by US with reference to the holding capacity of a Falls Creek Accommodation Transfer Service Transit Carry Bag. These carry bags are available for purchase from the Transfer Terminal. 5. We are not a common carrier and reserve the right, acting reasonably, to refuse carriage of any passenger, baggage, personal effects (including pets) or goods on any service. 6. You have certain rights under the Australian Consumer Law. These include consumer guarantees that the services carried out by Us (the service) will be supplied with due care and skill, will be fit for any purpose disclosed by You and will be supplied within a reasonable time. If We breach a consumer guarantee, you may be entitled to certain remedies under Part 5-4 of the Australian Consumer Law including a refund or resupply of the Service and compensation for any reasonably foreseeable loss. These terms and conditions do not exclude or limit the consumer guarantees or any other statutory rights that You may have under applicable laws which cannot be excluded. 7. Subject to the consumer guarantees referred to in paragraph 6 and otherwise to the fullest extent permitted by law: a)We shall not be liable or responsible for any loss, damage, injury, sickness, death or accident suffered or sustained by You nor any loss or damage to any of your personal effect, luggage or other goods or property or otherwise OR any other loss or expense arising out of or resulting directly or indirectly from Your use of the Service, howsoever caused. b)We will not be liable for fair wear and tear of baggage. 8. We may need to cancel the Service, alter or substitute routes, time tables, itineraries and schedules from time to time due to unsuitable weather conditions, technical problems, operational reasons, or events beyond Our reasonable control. Subject to the consumer guarantees and other applicable laws referred to in paragraph 6, We will not be liable for any loss you may incur as a result of any such change. 9. All cancellations must be made at least 24 hours before the time of travel and will incur a $10 cancellation fee. 10. You must produce a valid ticket prior to departure (which shall include evidence of payment for all luggage carried) in order to use the Service. 11. We do not refund for any lost, stolen, damaged or unused Pass/Ticket under any circumstances. 12. No Season Pass is transferable under any circumstances. | |
Falls Creek Dragon Boats Championships Registration Terms & Conditions | |
| 1. The organisers reserve the right to cancel and / or reschedule the event for an alternative date due to unforeseen circumstances. 2. The minimum age for a Paddler is twelve. 3. All competitors must sign a release, waiver and conditions of entry prior to competing. 4. If an individual competitor cannot be placed in a team a full refund will be made. 5. FCRM recommend competitors have their own accident and ambulance cover and private health insurance. | |

| Segway Teaser & Tour | |
| 1. All participants to sign waiver, all details must be completed. 2. All participants to arrive at meeting point 15 minutes to start time. In the event of participants arriving late for a tour, the booking will be cancelled. 3. All participants must wear close toe shoes. No open toes shoes allowed. 4. Minimum weight of participants is 45kg and maximum is 115kg. 5. Cancellations within 24 hours of booking will not be eligible for a refund or re-booking. 6. All participants must follow all instructions from the activity co-ordinator. 7. During ‘Extreme’, ‘Code Red’, ‘Advice’ and ‘Watch & Act’ Fire Danger ratings tours will be cancelled and rescheduled. 8. During an ‘electrical’ storm activity Tours will be suspended or cancelled. 9. All participants under the age of 18 must have an supervisory adult present to counter sign the waiver. 10. Teaser Sessions held at Slalom Plaza near Falls Express Chairlift 11. Teaser Sessions held during times of 10:00am to 12:00pm each Monday and 1:30pm to 3:30pm each Friday 12. Teaser Sessions run for approx 15 minutes, inclusive of guided instruction 13. Tours held out of the Nordic Bowl approx 2km beyond Village. 14. Tours held at specific times of 10:00am to 11:00am and 11:15am to 12:15pm each Wednesday, Saturday and Sunday 15. Tours run for approx 60 minutes, inclusive of guided instruction (Guests advised to arrive 15 minutes prior) 16. Minimum age limits apply 9yrs for 15 min Teaser and 11yrs for 60 minTour. 17. Minimum weight limits of 30kg and Maximum 120kg apply 18. Teaser Pre-Bookings advised with walk-up bookings subject to availability 19. Tour Pre-Bookings required 20. If there are no bookings for a session, the Activity Coordinator will remain on site for 30 minutes after the session start time to facilitate late bookings. 21. Segway tours and teasers will not run if it is raining or drizzling, rain is threatening or prolonged rain has impacted the tour route, as the electrical components of the Segway’s cannot get wet under any circumstances. | |

| 1. All participants to sign waiver, all details must be completed. 2. All participants under the age of 18 must be accompanied by an adult. 3. All participants must wear a life jacket. 4. All participants must follow all instructions from the activity co-ordinator. 5. During ‘Extreme’, ‘Code Red’, ‘Advice’ and ‘Watch & Act’ Fire Danger ratings tours will be cancelled and rescheduled. 6. During an ‘extreme weather’ hire services will be suspended or cancelled. 7. All participants under the age of 18 must have an supervisory adult present to counter sign the waiver. 8. Sessions held at Rocky Valley Foreshore. 9. Sessions held during at specific times of 1:30pm to 3:30pm each Wednesday, Saturday and Sunday. 10. Sessions run for approx 2 hours (guests advised to arrive 10 minutes prior). 11. Canoes seat 2 persons maximum. 12. Children under the age of 13 must be accompanied in canoe by a paying responsible adult. 13. Pre-Bookings required. 14. If there are no bookings for a session, the Activity Coordinator will remain on site for 30 minutes after the session start time to facilitate late bookings. | |

| Resort Management tracks some visitor information such as the number of times users visit pages within our website, the length of time spent within our website and other relevant information to assist us in statistical collection for analysis. Surveys / Competitions | |
| At various times Resort Management may conduct online competitions or surveys to assess specific issues, for example guest satisfaction. The type of survey questions asked may change however may include information such as age bracket, usual postcode of residence and ratings of various service levels, activities or events. All information provided remains confidential and will not be sold to third parties. High level aggregate data or non-personally identifiable information (for example guest feedback) may be shared with interested parties.
